At the Beginning, News That Will Devastate  Louise At the beginning of the story, Richards and Josephine believe they must break the news of Brently Mallards death to Louise Mallard as gently as possible. A Growing Awareness of Freedom Yet something even more unthinkable lurks in this story: Louises growing awareness of the freedom she will have without Brently. At first, she doesnt consciously allow herself to think about this freedom. The knowledge reaches her wordlessly and symbolically, via the open window through which she sees the open square in front of her house. The repetition of the word open emphasizes possibility and a lack of restrictions. Patches of Blue Sky Amid the Clouds The scene is full of energy  and hope. The trees are all aquiver with the new spring of life, the delicious breath of rain is in the air, sparrows are twittering, and Louise can hear someone singing a song in the distance. She can see patches of blue sky amid the clouds. She observes these patches of blue sky without registering what they might mean. Describing Louises gaze, Chopin writes, It was not a glance of reflection, but rather indicated a suspension of intelligent thought. If she had been thinking intelligently, social norms might have prevented her from such a heretical recognition. Instead, the world offers her veiled hints that she slowly pieces together without even realizing she is doing so. A Force Is Too Powerful to Oppose In fact, Louise resists the impending awareness, regarding it fearfully. As she begins to realize what it is, she strives to beat it back with her will. Yet its force is too powerful to oppose. This story can be uncomfortable to read because, on the surface, Louise seems to be glad that her husband has died. But that isnt quite accurate. She thinks of Brentlys kind, tender hands and the face that had never looked save with love upon her, and she recognizes that she has not finished weeping for him. Her Desire for Self-Determination But his death has made her see something she hasnt seen before and might likely never have seen if he had lived: her desire for self-determination. Once she allows herself to recognize her approaching freedom, she utters the word free over and over again, relishing it. Her fear and her uncomprehending stare are replaced by acceptance and excitement. She looks forward to years to come that would belong to her absolutely. She Would Live for Herself In one of the most important passages of the story, Chopin describes Louises vision of self-determination. Its not so much about getting rid of her husband as it is about being entirely in charge of her own life, body and soul. Chopin writes: There would be no one to live for her during those coming years; she would live for herself. There would be no powerful will bending hers in that blind persistence with which men and women believe they have a right to impose a will upon a fellow-creature. Note the phrase men and women. Louise never catalogs  any specific offenses Brently has committed against her; rather, the implication seems to be that marriage can be stifling for both parties. The Irony of Joy That Kills When Brently Mallard enters the house alive and well in the final scene, his appearance is utterly ordinary. He is a little travel-stained, composedly carrying his grip-sack and umbrella. His mundane appearance contrasts greatly with Louises feverish triumph and her walking down the stairs like a goddess of Victory. When the doctors determine that Louise died of heart disease of joy that kills, the reader immediately recognizes the irony. It seems clear that her shock was not joy over her husbands survival, but rather distress over losing her cherished, newfound freedom. Louise did briefly experience joy the joy of imagining herself in control of her own life. And it was the removal of that intense joy that led to her death.

To fully comprehend the research subject matter, it is important to give a brief overview of such principles, as detailed further below. Most commonly the Contractors obligations in respect of time for completion of the works are expressly defined [OV1]within the terms of contract, it is yet not uncommon for the extent of such obligations to be described less definitively. While the time for completion will be expressly defined as a fixed date or a fixed period and can be easily identified, it is also essential to for the contract to provide for the mechanism of establishing completion: e.g. commencement date where completion is determined by a fixed period. Where the time for completion is ill-defined to such extent that the contracting parties intentions cannot be established or are non-existent, then the law considers time to be at large [OV2]and implies a requirement to complete the works within reasonable time. The principle of reasonable time under English Law goes back to 19th century[1], where it was established that for if a delay is not attributed to causes within a partys control, nor such party acted negligently, it will be considered that obligations are duly fulfilled. Reasonableness cannot be given a strict definition and is assessed on a case-by-case basis, taking into consideration circumstances prevailing during the period of performance[2]. Some authors on the subject view that both ordinary (e.g. site access, government permits, resource availability, etc.) and extraordinary circumstances (e.g. strikes, client variations, etc) should be taken into consideration when establishing reasonable time[3]. Occasionally, some bespoke contracts may contain time is of the essence terms. In contractual context, it has stricter meaning than its everyday application: i.e. if something isnt done swiftly, it will be too late[OV4].[4] Inclusion of such terms in a contract significantly elevates the rights and obligations to the contract, whereby failure to meet the completion date will be treated as a fundamental breach of the contract[5]. Another area of significant importance in establishing whether completion date has been adhered to, is the meaning of completion itself. Ordinary meaning of completion[OV5] requires fulfilment of all obligations, which when applied in the context of entire contracts[OV6], may result in harsh consequences. It is extremely rare for construction contracts to be considered in the same manner and courts will generally take a practical view as to what constitutes completion within construction industry[7]. To reflect that position, standard construction contracts have developed various definitions for use in the industry, such as: practical[8] or substantial[9] [OV7]completion, which irrespective of the words used to describe it, are intended to reflect the courts position as summarised by Judge Newey QC[OV8]:[10] In my opinion there is no room for completion as distinct to practical completion. Because a building can seldom if ever be built precisely as required by drawings and specification, the contract realistically refers to practical completion and not completion but they mean the same. Eminent legal writers on this subject[11] concur with this view: Usually it will mean bona fide completion free of known or patent defects so as to enable the owner to enter into occupation. The words practical or substantial in the English standard forms do no more than indicate that trivial defects not affecting beneficial occupancy will not prevent completion (the more so, of course, if the contract provides for a maintenance or defects liability period) [12] Irrespective of exact term used, completion can be summarised as a significant gateway, which signifies: the transfer of risk for the care of the works from the Contractor to the Employer repossession of the site by the Employer the start of the period during which the Contractor will be liable for defects in the works the end of the Contractors liability for late completion release of retention monies from the Employer to the Contractor the end of Contractors obligation to insure the works Understanding of the above has a clear importance in resolving any disputes arising out of delay, extension of time and other time related matters. Understanding of this term may, in first instance, appear to have only a remote connection to the subject matter. However, as shown in the next chapters, it is of significant importance when it comes to establishing the contractors responsibility when the time of completion is set at large. The courts have held that the assessment of what constitutes diligence must be based on the surrounding circumstances of each case. For example, per Lord Justice Parker[13] what is due diligence and expedition depends, of course, on the object which is sought to be achieved, who went on to explain the relation between diligence and specific contract object, time scales, complexities, etc. Similarly, in the separate Court of Appeal case of West Faulkener Associates v London Borough of Newham (1994)[14] the court found that literal interpretation, commercial logic and common sense required the contractor to proceed both regularly and diligently.[15] In the absence of an explicit due diligence obligation within a contract, some authors consider that common law implies such a term on the grounds of business effic[OV9]acy[16]. William Hazlitt, a British writer during the early 1800’s once said, â€Å"Prejudice is the child of ignorance.† During the eighteenth-century, the time period in which Gotthold Ephraim Lessing wrote his play, Nathan the Wise, there was much religious prejudice displayed throughout Europe, specifically against the Jewish and Muslim populations. For instance, Ronald Schechter notes, â€Å"eighteenth-century writers typically portrayed Jews as greedy moneylenders, [and] depicted Muslims as violent despots and servants of the despots† (4). Many people perceived Christianity as the only true religion; however, Lessing challenges these notions of Christian superiority throughout his play. One way he does this is by not portraying the Christian characters as any better or worse than the characters of different religions; in fact, the Patriarch is characterized as a despot, similar to how eighteenth-century writers portrayed Muslims. Furthermore, he tries to illustrate that not one religion be it Christianity, Islam, or Judaism is greater than the others, but rather all religions are ultimately equal in the eyes of God. From factors such as characters’ portrayal, the play’s audience is able to grasp Lessing’s overall view of Christianity, which is also his main message throughout—â€Å"Christians do not have a monopoly on religious truths† (Schechter 10). In Lessing’s play there are four Christian characters and two of the four, Daja and the Patriarch, are portrayed negatively. Daja, a Christian servant of Nathan and his stepdaughter Recha, is characterized as â€Å"one of those fanatics who imagine they know the universal and only true path to God† (111). Although she tries to be a devout Christian, she betrays Nathan by revealing his secret regarding ... ...sides† (118). Although this is only a stage direction and not an actual line from the play, it nonetheless has a major impact on the play. The fact that all characters, representing each of the three religions, come together in the end exemplifies what the author is trying to portray throughout. As Ronald Schechter notes in the introduction, â€Å"The play does not end with the various characters tolerating each other. It ends with them embracing each other [†¦]† (20). Having the play conclude this way conveys Lessing’s thoughts on religion. Lessing does not think of Christianity as any better or worse than Judaism or Islam, rather â€Å"practitioners of different religions can please God equally† (Schechter 16). And until that higher, experienced judge comes down to rule which religion is better than the others, all religions should be thought as equal in the eyes of God.

The most affected population is women and children and the global community is charged with the responsibility of responding urgently to issues related to human trafficking. A number of approaches can be utilized by the international community to curb the problem of human trafficking. The most important approaches include the human rights approach, enhanced research into the problem of human trafficking, encouraging international judicial and the police cooperation as well as the community integration in the fight against human trafficking and providing support and assistance to victims of human trafficking (International Organization for Migration, 2008). One of the approaches that can help mitigate human trafficking is the human rights approach where the root causes of human trafficking such as patriarchal structures and gender based violence need to be brought into the limelight. These elements have been shown to favor several incidents of human trafficking particularly among the women. Policies and legislation on equal opportunities can help strengthen and protect the social and legal position of children and women and address gender and age discrimination. Support programs should be stepped up to strengthen efforts of fighting poverty and marginalization among vulnerable populations such as the girl child and women (Morrison, 2010). The global community should be keen not to confuse the fight against human trafficking with the fight against illicit immigration as there is need to scrutinize ways of increasing gainful, non-exploitative and legal migration of labor for the purpose of globalization. Education provision to vulnerable groups and creation of campaigns among the targeting clients can help reduce human trafficking (Morrison, 2010). The global community can combat human trafficking by encouraging research which will provide sufficient data and form a starting point of tackling the problem. Extensive research will indicate the scale of human trafficking and the mechanisms of exploitations. Information on human trafficking should be made available and this information should be shared bilaterally and multilaterally in order to facilitate good research on the problem (UNGIFT, 2009). Research on counter-trafficking responses will form a crucial component of combating human trafficking. This research will examine the reasons why clients of trafficked humans prefer the trade and check ways on solving the clients’ requirements. There should also be an extensive research that will focus on the needs of the vulnerable groups who mainly include women and children (UNGIFT, 2009). Another approach that can be used by the global community to combat human trafficking is the judicial and police cooperation which include the fight of corruption, checking on the investigative methods, exchange and specialization measures and legislative recommendations. The law should always ensure that there is protection of the witnesses and the victims, prohibit prostitute exploitation, ban illegal work and regulate national territory residence so as to combat such trafficking. There should be an introduction of adequate penalties into international and national legislation for such crimes that involve trafficking and other related offenses. Confidential and parallel investigation of the suspected traffickers’ financial affairs should be followed when identifying, sequestrating and confiscating the assets and proceeds of the human traffickers (UNGIFT, 2009). These should be legal provisions which may include the financial institution taking the legal duty to disclose any suspected transaction of money laundering to the agencies of law enforcement. However, the financial institution should not disclose any police enquires into the affairs of the suspect’s finances. The international community should ensure that states have legislations to assure the victims the right to secure and seek compensations for the harm and injuries they suffer during trafficking. Additionally, there should be direct contact between the judicial authorities and effective service of law enforcement for the purpose of speeding up information exchange in investigation process and having mutual legal support (UNGIFT, 2009). The approach of victim assistance and protection can help combat human trafficking. There should be an establishment of sufficient study and research to identify the trafficked victim and the traffickers’ profiles. This may include the design of key indicators of trafficking design matrix which can be used by the border personnel and the front-line police to assist them in distinguishing between the irregular migrant and the trafficked victims. The victims have to be provided with access to the support measures of all ranges such as shelter, sexual, psychological and physical health support and care. There should also be legal, social and independent health counseling to equip them with skills which will ensure that they avoid any future human trafficking predisposing factors (United Nations Office on Drugs and Crime, 2007). The global community can play a major role in combating incidents of human trafficking. This can be done by setting up rules and proving enabling environment that will discourage such crimes in the society. The approaches which look into the needs of both the traffickers and the trafficked individuals tend to strike a balance between caring both the offended and the offender as both are members of the community. Several organizations such as the United Nations have so far invested efforts to fight human trafficking although the cases of the illegal trade continue to be reported.
